Abstract

In the big data era, the medical and industrial fields are making various efforts to utilize medical information based on various technologies. Of course, it is true that the government is making positive evaluations for the pioneering of new industrial fields during the great transformation of the Fourth Industrial Revolution. However, compared with general personal information, medical information is much more necessary for protection in that the damage to the data subject can be very large in case of infringement. For this reason, the protection and utilization of medical information is often perceived as difficult to contradict or coexist with both sides of the coin.
In 2018, an amendment to the Privacy Act was proposed, which introduced the concept of 'pseudonym information'. This is defined as 'information that is not recognizable without the use and combination of additional information for the reconstruction of personal information to its original state,' which can be understood as being introduced to expand the scope of use of information. However, pseudonym information is likely to be restored to personal information, and in this case, a problem arises on how to solve the infringement of personal information. In particular, serious violations may occur if the pseudonymized medical information is restored.
The purpose of this paper is to determine whether the introduction of pseudonym information is legitimate among the amendment of the Personal Information Protection Act and what solutions can be suggested in case of problems related to the use of medical information.
